This page includes a list of forms that must be completed and submitted to the Texas Department of Agriculture (TDA).
In order to ensure your sites are approved and children fed, you should submit the completed Summer Food Service Program (SFSP) application and all necessary supporting documentation to TDA prior to April 15, 2010, or at least 30 days before you wish to begin participation. The final date to submit your SFSP application packet is June 15, 2010. SFSP site pre-approval policy states new sites must be visited by TDA representatives within 15 days after receipt of site information (Form 1507). The Sponsor may not claim reimbursement for meals until after the site is approved by TDA. New SFSP sites cannot be approved to begin participation until a site pre-approval visits is conducted, which may take up to 15 days to conduct. TDA reserves the right to approve the site without a pre-approval visit if certain pre-existing conditions and factors are present. Required Signatures
Only an Authorized Representative that has been authorized on Form H4508 Certificate of Authority, can sign program-related documents for your organization.
USDA Foods (Formerly USDA-Donated Commodities)
Sponsors eligible to receive USDA Foods (formerly USDA-donated commodities) under the SFSP include:
- Sponsors preparing meals onsite or at a central kitchen;
- Sponsors purchasing meals from an SFA that participates in the National School Lunch Program (NSLP); and
- SFA sponsors that procure their SFSP meals from the same food service management company that competitively provided their most recent NSLP and or School Breakfast Program (SBP) meals.
If your authorized representative for USDA Foods under the NSLP is different than the authorized representative for USDA Foods under the SFSP, you must complete and submit an original Form H4508.
Required Training
Due to increased program information that we would like to convey at this time, we are requiring all applicants to attend face-to-face training prior to the beginning of the operation of their 2010 SFSP. For your convenience, training sessions will be held in cities across the state between February and May. Suggested participants are the persons completing the application and budget, submitting the claims, or the person who performs these tasks in their absence.
Participants who have attended FND workshops in the past are expected to self-register online for the class. For more information about training, class dates and locations, click on “Training Schedule” in the navigation bar on the left-hand side of this web page.
You will receive a certificate verifying your completion of the required program training. You must submit a copy of the certificate before your application will be approved.
Site Access
If your School Food Authority (SFA) sponsors a SFSP
feeding site(s) at which summer school will be in session, Federal Regulations
require that such sites be open to both children enrolled in the summer school
and to all children (18 years old and younger) residing in the area served by
the site.
Outreach Materials
Outreach materials and instructions for their use will be provided upon approval of the SFSP application.
Appeal Rights
You have the right to appeal TDA adverse actions that affect your claims for reimbursement or participation in the program. Requests for an appeal must be received by TDA within 10 days of receipt of notification of an adverse action. The appeal must:
- Be in writing;
- State the basis for the appeal of the adverse action;
- Include a legible copy of the adverse action letter.
If you wish to have an in-person hearing, you must request a hearing at the time you file your written appeal. If you do not include a written hearing request in your appeal, you waive the right to a hearing and the appeal will be decided upon review of the documents in the record, unless the Administrative Review Official (ARO) determines that the failure to make a timely request was due to circumstances beyond the control of the appellant.

The rules regarding the appeal procedures for SFSP are found in Title 4 of the Texas Administrative Code Sections 1.1010 and 1.1011.
Note: Documentation you wish to have considered for your appeal must be submitted to the address above within seven (7) days after submitting the request for administrative review. You can submit the documentation with your request for an appeal, or separately.
